If you have been in an accident involving an Uber or Lyft driver – whether you are an injured driver or passenger – do you know who would be responsible for compensating for your pain & suffering?
You may be able to go after both Uber/Lyft and the driver’s individual insurance. However, Uber and Lyft coverage for an accident is a little bit complicated.
Uber and Lyft Coverage and Liability in an Accident
Uber and Lyft insurance policies only go into effect when their drivers have passengers in the vehicle or are searching for passengers.
This type of insurance policy can sometimes create a gray area when their drivers get into accidents – especially when they are not logged in, but are still conducting activities related to the rideshare company.
There are 3 defined periods during a driver’s time on the clock. They determine when the company’s insurance coverage is used versus when the driver’s personal insurance is used.
No Period
When a driver is not logged onto their rideshare app, they are not considered to be working. Therefore, they are not covered by Uber/Lyft’s insurance. Any accidents that they may be involved in would only be covered by their personal insurance.
Period 1
Period 1 is for when an active driver is logged on to their app and is actively waiting for a passenger, but is not on the way to a passenger, or having a passenger in the car. The rideshare company must provide liability coverage of $200,000 for its driver. This results in up to $100,000 in death/personal liability coverage per incident and up to $50,000 per person.
Period 2
This is when the driver has agreed to a request but is on their way to pick up the passenger. The commercial insurance coverage of up to $1 million kicks in.
Period 3
Period 3 occurs the moment the passenger gets inside of the driver’s vehicle. At this time, Uber and Lyft companies also provide $1 million in coverage.
For the three periods above, both Uber/Lyft insurance and the driver’s personal insurance can be used to compensate you for your injuries. Understanding the coverages offered during each period is essential when seeking compensation if you suffered in an accident.
If you have been involved in an Uber or Lyft accident, it’s a little bit more complicated to get the compensation you deserve. Many times, the injured parties are quickly offered the minimal amount and pressured into taking it.
